Absolutely! Positive action is lawful under sections 158 and 159 of the Equality Act 2010. This legislation states that employers can take voluntary actions to address any imbalance of opportunity where they perceive that people who share a protected characteristic (namely age, disability, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and/or sexual orientation) suffer a disadvantage or are disproportionately under-represented.
